The Trump Administration Requests High Court Clearance for Military Reserve Forces in Illinois
On Friday, the White House submitted an urgent appeal to the US supreme court, asking for approval to deploy state guard forces to Chicago and surrounding areas.
This move is part of a wider effort to widen the domestic use of the troops in a number of cities run by Democrats.
Legal Battle Over Military Presence
In an emergency filing, the justice department pressed the bench to overturn a earlier court order that had stopped the sending of several hundred state guard members to the greater Chicago.
The presiding judge had expressed skepticism about the government's justification for activating the guard, questioning its rationale in given the situation on the ground.
A higher court supported the initial ruling on the previous day, maintaining the stationing on standby while the legal challenge continues.
Administration's Claims
The federal legal representative, representing the government, wrote in the new filing that government officers have frequently been “threatened and assaulted” in downtown Chicago and the neighboring town of Broadview area.

The former president has already sent military reserve personnel to Chicago and Portland, after previous deployments to LA, Memphis, and Washington DC.
The president has claimed that military intervention is required to reduce protests and strengthen immigration enforcement.

At the heart of the conflict is the government's invocation of a federal statute allowing the commander-in-chief to federalize the national guard only in cases of rebellion or when “powerless with the standard military to enforce the laws of the United States”.
The White House argues that the troops are required to safeguard government buildings and personnel from protesters.

Earlier this month, the government federalized several hundred members of the Illinois national guard and ordered extra Texas national guard troops into the Illinois.
